This Terms & Payment Policy (“Policy”) governs every estimate, project, and service performed by QPS Home Services (“QPS,” “we,” “us”) for a customer (“you,” “Client”). By submitting your initial deposit on an estimate, you acknowledge that you have read, understood, and agreed to this Policy in full. If you do not agree to these terms, do not submit a deposit or authorize QPS to begin work.
If this Agreement is signed at the Client's residence, the Client has the right to cancel within three (3) business days of signing, for any reason and without penalty, in accordance with Colorado and federal law. To cancel under this section, the Client must provide written notice (email or letter) to QPS before the end of the third business day. Any deposit paid will be refunded in full within 10 business days of a valid cancellation made under this section. This right does not apply once the three-day period has passed, or to agreements signed at QPS's place of business.
Once the right-to-cancel period in Section 2 has passed and QPS has begun work, QPS commits crew time, materials, and scheduling resources to the project. If the Client cancels after this point, the amount owed is based on how much of the project was completed at the time of cancellation:
Submitting the initial 65% deposit constitutes the Client's full and binding acceptance of this Policy in its entirety, including the cancellation terms in Section 3. QPS recommends reviewing this Policy carefully before authorizing any deposit or work order. Verbal agreements do not modify this Policy — changes must be made in writing and signed by both parties.
If a dispute over payment, cancellation, or project scope cannot be resolved directly between the parties, the parties agree to first attempt good-faith mediation before pursuing formal legal action. Should a dispute proceed to arbitration or court, the prevailing party shall be entitled to recover reasonable attorneys' fees, court costs, and related expenses from the non-prevailing party, to the fullest extent permitted under Colorado law.
Payment of the initial 65% deposit serves as the Client's acknowledgment of, and binding agreement to, the QPS Home Services Terms & Payment Policy above, including the 65% deposit requirement and the tiered cancellation liability described in Section 3. No separate signature is required — submitting the deposit is the Client's acceptance of these terms.
