Terms & Payment Policy

This Terms & Payment Policy (“Policy”) governs every estimate, project, and service performed by QPS Home Services (“QPS,” “we,” “us”) for a customer (“you,” “Client”). By submitting your initial deposit on an estimate, you acknowledge that you have read, understood, and agreed to this Policy in full. If you do not agree to these terms, do not submit a deposit or authorize QPS to begin work.

1. Deposit & Payment Schedule

• A deposit equal to 65% of the total project estimate is due before any work, materials purchase, or scheduling begins.
• The remaining 35% balance is due in full upon substantial completion of the project, prior to final walkthrough sign-off, unless a different schedule is agreed to in writing.
• Estimates are based on the scope of work discussed at the time of quoting. Material changes to scope, materials, or timeline requested by the Client may result in a revised estimate and adjusted deposit.

2. Right to Cancel

If this Agreement is signed at the Client's residence, the Client has the right to cancel within three (3) business days of signing, for any reason and without penalty, in accordance with Colorado and federal law. To cancel under this section, the Client must provide written notice (email or letter) to QPS before the end of the third business day. Any deposit paid will be refunded in full within 10 business days of a valid cancellation made under this section. This right does not apply once the three-day period has passed, or to agreements signed at QPS's place of business.

3. Cancellation Policy

Once the right-to-cancel period in Section 2 has passed and QPS has begun work, QPS commits crew time, materials, and scheduling resources to the project. If the Client cancels after this point, the amount owed is based on how much of the project was completed at the time of cancellation:

• Less than 25% complete: the Client owes QPS's actual costs incurred to date (materials, labor, permits, and similar costs) plus a reasonable profit allowance, not to exceed the full project estimate.
• 25%–75% complete: the Client owes 85% of the total project estimate.
• More than 75% complete: the Client owes the full 100% of the total project estimate.
• The 65% deposit will be applied toward whichever amount is owed above. Any remaining balance is due within 10 days of cancellation. If the deposit paid exceeds the amount owed, QPS will refund the difference within 10 business days.

4. Acceptance of Terms

Submitting the initial 65% deposit constitutes the Client's full and binding acceptance of this Policy in its entirety, including the cancellation terms in Section 3. QPS recommends reviewing this Policy carefully before authorizing any deposit or work order. Verbal agreements do not modify this Policy — changes must be made in writing and signed by both parties.

5. Disputes & Legal Costs

If a dispute over payment, cancellation, or project scope cannot be resolved directly between the parties, the parties agree to first attempt good-faith mediation before pursuing formal legal action. Should a dispute proceed to arbitration or court, the prevailing party shall be entitled to recover reasonable attorneys' fees, court costs, and related expenses from the non-prevailing party, to the fullest extent permitted under Colorado law.

6. General

• This Policy is governed by the laws of the State of Colorado.
• If any provision of this Policy is found unenforceable, the remaining provisions remain in full effect.
• QPS reserves the right to update this Policy for future projects; the version in effect at the time of your deposit governs your project.
